Thomas J. Hurney, Jr.
Tom Hurney has over thirty three years experience in trials of cases involving serious personal injury, wrongful death and commercial matters. He has substantial experience defending medical liability actions and other health care related issues. He currently represents clients in class actions involving chemical releases, contaminated steroids and medical record charges.
Tom has appeared before the Supreme Court of Appeals of West Virginia over twenty times. Recent cases include the successful appellate defense of the constitutionality of West Virginia's non economic caps, and a significant case absolving hospitals of liability for non-employed physicians. He recently filed an amicus brief in a successful case involving appellate rights of surface owners, and has filed briefs in a variety of health care, products liability and industrial injury cases.
Tom is a Fellow of the American College of Trial Lawyers (ACTL), and an Associate member of the American Board of Trial Advocates. Active in DRI and other defense groups, he is a past president of the Defense Trial Counsel of West Virginia which gave him its first "Defense Lawyer of the Year" award in 2014. Tom is the President-Elect of the ADTA, a member of IADC and taught in its 2014 Trial Academy - The Penhooligans. He is a frequent speaker on a variety of legal topics, with presentations at DRI and other meetings.
Tom has an AV preeminent rating by Martindale-Hubbell and has been recognized in various peer publications, including Best Lawyers in America®, BTI, Chambers USA, Law & Politics' West Virginia Super Lawyers®, which recognized him as a Top Ten West Virginia Lawyer, and Benchmark, where he is recognized as a local Litigation Star.
Tom received both his law (cum laude, 1983) and undergraduate (Business Administration, 1980) from the University of Dayton, and remains a loyal Flyers fan.
